                                                                                                                                                 Yeoman of Stourpaine, died Testate

1700-05       Elias Brookes is estimated born between 1700-1705.  Nothing conclusive has been found relating to his parents or lineage.  This research is marked for research 
                    in the near future. 

1728             Elias first appears in the Parish Books in Dorset in his marriage to Elizabeth Bryan 9th Sept 1728 at Shapwick. 
                     The couple settled at Charlton Marshall where eight children were born of whom four died in infancy. At some point after between 1739 and 1762 
                     Elias left Carlton Marshall and journeyed to North Dorset to the village of Stourpaine where he recorded two further daughters.  Evidence reveals that Elias
                     and his family lived in a Tenement comprising a Cottage, Orchard and Garden.  He remained at Stourpaine until his death in 1785. At his death his Estates 
                     were considerable.

Married William Thaine and had issue

1739         Elias's spouse Elizabeth was the niece of Andrew Bryant a clothier who died testate at nearby Iwerne Minster in 1739.  Elias and Elizabeth's eldest daughter Mary
                 still in her minority (aged ten years) was a Legatee and named Executrix.  In the interim of Mary Brookes reaching adulthood, her father Elias and Joshua Rogers
                (married Andrew's sister Martha) were named Trustees of the Estate.   It was around this time that Elias and Elizabeth moved north to Stourpaine.
                 From the details in this Will, Elizabeth Bryan's ancestry is marked for research in the near future.

                  The Last Will and Testament of  I  Andrew Bryan of Iwerne Minster in the County of Dorset, Clothier, made the sixth day of February in the year of our Lord one 
                  Thousand seven hundred and thirty nine. First I commend my soul to God and my Body to the Earth and decent Burial and as touching such worldly Estate as the 
                  Lord in money hath (?) me I  dispose thereof as follows. First I give unto my brother John Bryan linen and woolen  (except one Great Broadcloth Coat and two 
                  waistcoats to wit, one flowers & the other a white fustian) Also I give unto my Brother Francis Bryan my Gray Broad Cloth Coat, Also I give unto my Brother 
                  Jonathon Bryan my flowered waist cote  & Fustian waistcoat together with my silver shoe Buckles.  Also I give unto my sister Mary Bown, nine  pounds. Also 
                  I give unto my sister Martha Rogers the sum of nine pounds.  Also I give unto my sister Rebecca Bryan the sum of twelve pounds and lastly all the rest of my Goods
                  and Chattels, Stock in Trade, rights and Credit Bills, writings obligatory whatsoever my debts,  Legacies and funeral expenses being first paid I give unto Mary Brooks,
                  Spinster daughter of Elias Brooks of Charlton Marshall in the County of Dorset,  yeoman Whom I make sole Executrix of this my last Will and Testament And  further
                  I do devise nominate & appoint the said Elias Brooks and Joshua  Rogers both of Carleton aforesaid Executors in Trust to see the (?) execution  hereof In witness 
                  whereof I this Andrew Bryan have have (?) unto forth my hand  and Seal the day and year above said.  Andrew Bryan (signed) with Seal. Signed, sealed, published and
                  declared as and for the last Will and Testament of the Andrew Bryan in the  presence of us Jno Spinney (signed) James Weare (signed)
1768          Elizabeth Brookes [nee Bryan] was buried 16th May 1768 at Stourpaine with the annotation "wife of Elias Brooks"  She was survived by her widowed spouse
                  Elias of forty years marriage and their surviving children;  Robert aged 36yrs (assumed unmarried) ; Elizabeth [now the wife of James Scard] aged 29yrs; 
                  Christian aged 22yrs (unmarried) and Angel, aged around sixteen.  It is not certain whether their eldest daughter Mary was living at this time.   Mary was not 
                  mentioned in the Will of her father in 1785. 

1768          Elias was left with his youngest daughter still in adolescence 

                  * "Only two months later Elias married Sarah Rabbets by licence on 25th July in Stourpaine.  (Sarum Marriage Licence Bonds)."

                  Full Details:    Elias Brooks, Farmer of Stourpaine, Dorset to Sarah Rabbets, widow of Stourpaine, Dorset on the 25th July 1768.  
                  The bondsman was William Jefferies, Yeoman of Salisbury, Wiltshire.    The relationship between the bondsman and/or the bride/groom is at the present unknown.                  

1786          Elias Brooks died Testate, buried at Stourpaine on the 17th April 1786 [G=1787].  A digitised copy of the inventory relating to his Estate is preserved at the 
                  National Archives, Surrey but has not yet been retrieved.  Indexed online viz:

                  His second wife Sarah (formerly Rabbetts) is not mentioned is considered to have predeceased him.

                This is the Last Will and Testament of me Elias Brookes of Stourpaine in the County of Dorset, Yeoman, made and published on the 13th day of July 1785 
                as follows that is to say First I give and bequeath to the four children of my daughter Elizabeth Scard the wife of James Scard the sum of fifty pounds each 
                to be paid to each of them at their respective ages of twenty-one years and in case either of them shall die before he she or they shall attain that age, the 
                part and share of such child so dying shall go and belong to the survivor or survivors of them.  Also I give and bequeath to my granddaughter Mary Ann Thaine
                the sum of fifty pounds to be paid at her age of twenty-one years and in case she shall die before she shall attain her said age, the same shall go and belong to
                her brother Elias Brookes Thaine.   Also I give and bequeath to my grandson the said Elias Brookes Thaine, the dwelling house, tenement, orchard and garden
                where I now live situate in Stourpaine aforesaid to hold to him, his executors and administrators for the reside of the Term and Interest. I leave whereupon 
                condition and [?] that he shall from time to time permit and suffer my daughter Angel Thaine and my said granddaughter Mary Ann Thaine (as they or 
                other of them [?] [?]) to dwell and inhabit therein or forfeit and pay to each of them the sum of ten pounds on his refusal so to so or deny or disturbing them
                therein.  Also I give and bequeath to my grandson Robert Gear, son of my daughter Christian Gear the sum of fifty pounds to be paid at his age of twenty five 
                years and interest forthwith same at the rate of four pounds ten shillings by the hundred from the year of his attaining the age of twenty-one and in case he
                shall die before he shall attain his said age twenty five years the same to go to and be divided between the children of my said daughters Elizabeth Scard and 
                Angel Thaine equally.  Then as to all the rest  residue of my goods and chattels, effects, furniture [?] and wearing apparel all other of my Estate whatsoever 
                and wheresoever I give and dispose thereof as followeth (that is to say) I give and bequeath one [?] or part thereof unto my daughter Elizabeth Scard and the 
                other [?] or half part thereof I give and bequeath to Samuel Gulliver of Orchard in the County of Dorset in trust for the children of my said daughter 
                Angel Thaine namely the said Elias Brooke Thaine and Mary Ann Thaine to be paid to them at their respective ages of twenty one years and if either of them
                shall die under that age the part of him or her so dying to go and belong to the survivor of them. And whereas I leave [?] to my daughter Angel Thaine the 
                sum of four hundred pounds for which she hath entered unto a bond or obligation bearing even late with this my Will now I hereby order and direct that 
                the said sum of four hundred pounds so above named to my said daughter and secured to me by the said bond shall be taken and [?] as part and shall be 
                deducted from the [?] of the residue of my Estate and effects bequeathed to the said Samuel Gulliver in trust for the children of my said daughter 
                Angel Thaine aforesaid. And lastly I make, nominate and appoint  the said Samuel Gulliver Executor  of this my Will declaring this to be my only last Will 
                and Testament in witness whereof I have hereunto set my hand and seal the day and year first above written - the mark X of Elias Brookes - [small seal] 
                signed sealed published and declared by the testator as for his Last Will and Testament in the presence of us Thos Waters [signed] Ann Roberts[signed].
           
               PROVED 18th day of August 1786. 
                                 On the 18th day of August in the year of Our Lord one thousand seven hundred and eighty six administration  (with the Will annexed) of all and 
                                 singular the goods chattels and credits of Elias Brookes late of Stourpaine in the County of Dorset deceased was granted to Elizabeth Scard (wife 
                                 of James Scard) the natural and lawful daughter of the said deceased and one of the residuary legatees named in the said Will leaven [?] first sworn 
                                 - - - - - - - duly to administer Samuel Gulliver otherwise Gulliver the sole executor name in the said Will first nominated this executor thereof.
                                                                                    Epilogue
Daughter Elizabeth Brookes (Scard)

                                    Elias's daughter Elizabeth Brookes married James Scard, a widower and miller,  by Licence on the 8th September 1762 both recorded 'of Stourpaine'.  
                                    Elizabeth & James Scard had five children;
                                               -  John Scard baptised 1763
                                               - Thomas Scard baptised 1765 - died in infancy
                                               - Elizabeth Scard baptised 1768
                                               - James Scard baptised 1770
                                               - Maria Scard baptised 1777
                                   Elizabeth and her four surviving children were legatees in the Will of her father Elias Brookes in 1785
                                   Elizabeth died testate in 1800, a widow, at the age of sixty-four.    Her Will is transcribed in the link below.

Daughter Christian Brookes (Gear)

                               Elias's daughter Christian Brookes, married Thomas Gear in 1776 [G=1777] at Melcombe Regis.
                                   "23rd Feb 1774  Mr. Thomas Gear, of this Parish,  widower & joiner and Christian Brooks of 'Stower Pain'  
                                     in the county of Dorset, spinster married in this chapel by Licence by me Geo Shuttleworth Rector all parties signed
                                     Witnesses  Hugh Smith & John Brenson.  
                                     Christian had two known children;
                                                 - Elias Gear baptised 31st Oct  1774 son of Thomas & Christian Gear  (Melcombe Regis)
                                                         – Elias Gear was buried 11th  Nov 1774  (Melcombe Regis) - an infant
                                                 -  Robert Gear baptised 24th May 1776 (Melcombe Regis)
                              Christian was not mentioned in the Will of her father Elias Brookes in 1786 believed to have predeceased him.
                              Her only surviving son Robert was a legatee in the above Will.
                              No further information has been found to date. 

Daughter Angel Brookes (Thaine) 

                               Elias's daughter Angel Brookes married William Thaine before 1768.  Her  spouse may have been in HM Service.
                               Angel had three known children;

                                      -  Simon Thaine baptised 25th December 1769 son of Mr. William Thaine and Angil his wife at Stourpaine 
                                                                    - Simon Thaine was buried Oct ye 11th 1771
                                      -  Elias Brookes Thaine born 31st  May 1776 and baptised 8th June 1776 at Stourpaine
                                                     - Elias Brookes Thaine grandson of Elias Brookes by his daughter Angel
                                                     - Elias Brookes Thaine entered HM Service.   
                                                     - Elias Thaine married Claudina Omedia in 1812 the notice of his marriage appeared
                                                               in the Selected Reports from the Salisbury and Winchester Journal; 
                                                               Salisbury March 23rd 1812;
                                                                          "On the 19th December was married, at Messina, Lieut. E.B. Thaine, 
                                                                            10th Regiment a foot to Miss Claudina Omedia, only daughter of  
                                                                            D. Fredrico Omedia, Major and Governor of the Garrison of Tormina, 
                                                                            Sicily." 
                                                     -       He died in 1840 his name appearing in the Obituaries 'Gentleman's Magazine 1840'
                                                             ' Obituaries: Lately;
                                                                            Capt. Elias Brookes Thaine formerly of the 10th a foot Regiment, at Malta, 
                                                                            aged 64."
                                      -  Mary Ann Thaine baptised 29th Dec 1778  daughter of Mr. Willm Thaine and Angel his wife at Stourpaine
                                         Angel and both her surviving children were legatees in the Will of her father Elias Brookes in 1785

                                         Submission:  ".... Indentures I found an apprenticeship for a Mary Ann Thaine to Sarah Hill, mantua maker in Blandford Forum dated 1794.
